Our Local Markets ABN 69685869034 – Terms and Conditions for members

In addition to the general terms & conditions, markets and stallholders are bound to the below terms & conditions applicable to markets and stallholders.

1. Eligibility to Sell

Stallholders must have a registered business within Australia in order to sell items on the Website and adhere to all relevant laws (including heath and safety laws and regulations) and provide and maintain valid payment information on the Website. Items listed by sellers from outside Australia will be deleted without warning without refund.

2. Display of Information on the Website

Markets and stallholders guarantee that the material display on the Website, including without limitation all editorial materials, information, photographs, illustrations, artwork and other graphic materials, names, logos and trademarks:
- are not false, misleading or inaccurate, or otherwise in contravention of the Competition and Consumer Act 2010
- are not fraudulent and do not involve the sale of illegal, counterfeit or stolen goods;
- do not infringe upon any third party's intellectual property rights
- do not contact items that are prohibited and/or dangerous to be lodged for carriage through postal system. 

3. Intellectual property

Our Local Markets does not claim ownership rights in the content you place on the Website. You grant Our Local Markets a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, license to exercise the copyright, publicity, and database rights you have in the content. You agree to allow Our Local Markets to store, display and re-format your content on the Website, in media publications, in marketing material and on other sites, in any way as Our Local Markets chooses. You warrant that you are the author of the content for the purposes of the Copyright Act 1968.  You agree that Our Local Markets may use and display your content without attribution of authorship and bearing the name of Our Local Markets, even if that would, apart from these terms, infringe your moral rights. You agree, to the extent permitted by law, not to enforce any claim for a breach of your moral right of integrity of authorship under the Copyright Act 1968 that you may otherwise have as a result of any act or omission of Our Local Markets in respect of the content.

4. Fees and Services

Our Local Markets collects initial setup fees for setting up your webpage and collects on-going membership fees from members for advertising, maintenance of the webpages, and other services. 

Individual stallholders that are selling their product on Our Local Markets Website will be charged a flat stallholder fee.

The Fees are subject to change and are effective after Our Local Markets provides you with at least fourteen (14) days' notice by posting the changes on the Website. Our Local Markets may, at Our Local Markets sole discretion, change some or all of Our Local Markets services at any time. In the event Our Local Markets introduces a new service, the fees for that service are effective at the launch of the service. You are responsible for paying all fees and applicable taxes associated with using the service. Unless otherwise stated, all fees are quoted in Australian Dollars (AUD). 

If Our Local Markets terminates a listing or your account, if you close your account, or if the payment of your Our Local Markets fees cannot be completed for any reason, you remain obligated to pay Our Local Markets for all unpaid fees plus any interest, if applicable. If the membership account is not paid in full and becomes past due, the member risks the suspension of privileges and/or termination of the account and other collection mechanisms (including retaining collection agencies and legal action). If you have a question or wish to dispute a charge contact Our Local Market at 

Our Local Markets will send out invoices via emails to all members on the 1st of the month. All invoices shall be payed in full by the 7th of the month.

6. Listing and Selling products on the Website

By listing an item on the Website for sale you warrant that you have complied with all applicable laws and terms and conditions. You also warrant that you are legally able to sell the item. You must accurately describe your item and all terms of sale in your Our Local Markets store profile and store policy. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. All items must be listed in an appropriate category with appropriate tags. 

All sellers are required to abide to Our Local Markets's policies. These policies includes shipping, returns, and selling policies. Sellers may however suggest changes or addition to the current policies for our consideration.

All sales are binding. The seller must ensure that the item listed for sale is available for purchase by a buyer. The seller is obligated to send the order or otherwise complete the transaction with the buyer in a prompt manner, unless there is an exceptional circumstance, including but not limited to for example if the buyer fails to meet the terms of the seller’s store policy. The seller must ensure that the item is described correctly and in the specified condition. The seller is responsible for shipping the item to the buyer within 48 hours of payment completion unless agreed otherwise with the buyer.

By posting content on the Website, it is possible for an outside website or a third party to re-post that content. You agree to hold Our Local Markets harmless for any dispute concerning such use. If you choose to display your own Our Local Markets hosted image on another website, the image must provide a link back to its listing page on Our Local Markets. 

Our Local Markets reserves the right to remove any item/s that is deemed unsuitable to be sold on the Website without warning. Our Local Markets reserves the right to remove or shut down of your online store account with Our Local Markets at any time.

7. Event organisers

One of the service that Our Local Markets provides for our stall-holder members is to notify them of upcoming events so they get first in chance to apply for a spot at your market. For this reason, we urge that you notify us of your planned events prior to public release.

Also, this would allow us to advertise your events at the website from the get go.

8. Honour the Privacy of Others

You may not contact the buyer by email or any other means for any reason other than to discuss the processing and progress of Our Local Markets online store transaction. You may not harass other members of Our Local Markets in any form. Our Local Markets will terminate your membership with us if complaints are received.

9. Agreement

By becoming a member of Our Local Markets, you confirmed that you have read this terms and conditions and have agreed to it. Breach to Our Local Markets Policies will result in revoke of your membership with us.
